These Terms and Conditions (“Terms”) govern all freight transportation and related services provided by Red Rocket Transport (“Red Rocket,” “we,” or “us”), a veteran-owned freight transportation company based in Compton, California. By tendering freight, booking loads, or otherwise using our services, you agree to be bound by these Terms on behalf of yourself and any company or entity you represent (“Shipper” or “Customer”). These Terms apply to all shipments handled by Red Rocket, whether arranged directly with the Shipper, a broker, a third-party logistics provider, or any other intermediary. These Terms are in addition to, and shall supplement, any applicable tariffs, accessorial schedules, rate confirmations, and written service agreements. In the event of a direct conflict with a separately executed written agreement signed by both parties, the written agreement will control.

Services

Red Rocket provides professional freight transportation services across Southern California.

Rail Drayage: Movement of containers and trailers to and from rail yards and intermodal facilities, including first-mile and last-mile delivery to warehouses and distribution centers.
Power-Only Services: Provision of tractors and professional drivers to haul customer-owned or leased trailers between mutually agreed origin and destination points.
Port Drayage: Transportation of containers to and from locations outside marine terminal gates, including pickup and delivery between off-dock container yards, chassis pools, freight stations, warehouses, and distribution centers.

Red Rocket does not hold terminal access credentials or registrations for the Ports of Los Angeles or Long Beach marine terminals. Shipments requiring direct terminal gate transactions must be arranged through a licensed drayage operator holding required terminal access.

Red Rocket operates solely as a motor carrier for property under applicable federal and state law.

Rates

All rates and quotes are based on information provided by the Shipper, including origin, destination, equipment type, weight, commodity, and special handling requirements. Red Rocket reserves the right to adjust rates if actual shipment details differ from those provided at booking.

Accessorial charges may include detention, layover, chassis fees, demurrage, per diem, storage, stop-off charges, driver assist, liftgate, tolls, and fuel surcharges.

Invoices are due within thirty (30) days of invoice date. Payment accepted by check, ACH, or wire transfer in U.S. dollars only. Late amounts may incur finance charges at the maximum rate permitted by law. The Shipper is responsible for all collection costs including attorneys’ fees and court costs.

Shipper Responsibilities

The Shipper must provide accurate shipment information including commodity description, weight, dimensions, hazardous classification, and special handling requirements. Red Rocket relies on this information and bears no liability for delays caused by inaccurate details.

The Shipper is responsible for proper packaging, blocking, bracing, and securing of freight to withstand normal transportation hazards. Where the Shipper loads or seals the trailer, Red Rocket bears no responsibility for damage caused by improper loading not visible from the exterior.

The Shipper must comply with all federal, state, and local hazardous materials regulations, including proper classification, packaging, marking, labeling, placarding, and documentation. Red Rocket may refuse any shipment that is improperly declared, packaged, or documented in its reasonable judgment.

For shipments involving port-adjacent facilities, the Shipper is responsible for all customs, security, and port-related documentation. Red Rocket bears no responsibility for delays or penalties from documentation issues outside its control. The Shipper bears sole responsibility for arranging any terminal gate transactions requiring credentialed terminal access at the Ports of Los Angeles or Long Beach.

Liability

Red Rocket’s liability for cargo loss, damage, or delay is governed by applicable federal motor carrier law, including the Carmack Amendment (49 U.S.C. § 14706). Maximum liability is the lesser of: (a) actual documented value, (b) Shipper’s cost of goods, or (c) any per-pound or per-shipment limitation in an applicable tariff or agreement.

Red Rocket bears no liability for consequential, incidental, special, or punitive damages including lost profits or business interruption. Exclusions from liability include acts of the Shipper, inherent vice, improper packaging, concealed damage, acts of public authorities, riots, acts of God, or causes beyond Red Rocket’s reasonable control.

Claims

All cargo claims must be filed in writing within nine (9) months from the date of delivery, or nine (9) months from the expected delivery date in cases of non-delivery. Claims must include shipment details, description of loss, claimed amount, and supporting documentation.

Any lawsuit must be filed within two (2) years from the date Red Rocket provides written notice of claim denial. Failure to meet these deadlines bars the claim.

Prohibited Shipments

Red Rocket may refuse improperly documented hazardous materials, contraband or illegal goods, and goods posing unreasonable risk to health, safety, or property. Shippers tendering prohibited shipments without disclosure shall indemnify Red Rocket from all resulting claims, fines, penalties, and expenses.

Force Majeure

Red Rocket bears no liability for delays caused by port congestion, vessel or rail delays, weather, natural disasters, governmental orders, labor disputes, or equipment failures beyond its control.

Governing Law

These Terms are governed by the laws of the State of California, except where superseded by federal transportation law. All legal proceedings shall be brought exclusively in state or federal courts in Los Angeles County, California.

SMS Communications

Messaging Program. By opting in, you agree to receive load booking confirmations, appointment confirmations and updates, pickup and delivery confirmations and updates, missed-call auto replies, and conversational customer support and inquiries from Red Rocket Transport. You agree to receive SMS messages about load booking confirmations, appointment confirmations and updates, pickup and delivery confirmations and updates, missed-call auto replies, and conversational customer support and inquiries only. All messages are informational. Red Rocket Transport does not send marketing or promotional messages via SMS.

Opt-In. By providing a mobile phone number to Red Rocket verbally, over the phone, or in person, you consent to receive SMS messages for the purposes described in Section 9.1. Message frequency varies based on communication needs.

Opt-Out. Reply STOP to any message to unsubscribe. After opting out, you will receive one final confirmation message and no further SMS messages from Red Rocket Transport. To resume receiving messages, contact us directly.

Message and Data Rates. Standard message and data rates may apply depending on your mobile carrier plan. Red Rocket Transport is not responsible for charges incurred by the recipient.

Carriers. Carriers are not liable for delayed or undelivered messages.

Data Sharing. Customer data is not shared with third parties for promotional or marketing purposes. Mobile opt-in and consent are never shared with anyone for any purpose. Any information sharing mentioned elsewhere in this document excludes mobile opt-in data.
